Pink Cherrie Productions CC (‘the agency”) Ref number 2008/216205/23 shall provide for you (“the client”) temporary personnel for promotional events in accordance with these terms and conditions, unless such is varied in writing by agreement between the parties.
Payment
Existing clients:
- An existing client(defined as having settled a minimum of two invoices in full) are required to pay 50% upon written confirmation, with the balance payable within seven days of completion.
New Clients:
- New clients will be required to pay 70% upfront upon written confirmation, with the balance payable within seven days of completion.
Cancellations
- Where cancellations take place more than 48 hours before the date specified for the promotion or event, 50% of the value of the agreed fees shall be paid to Pink Cherrie.
- Where cancellation take place less than 48 hours before the date specifies for the promotion or event, 80% of the value of the agreed fee shall be paid to Pink Cherrie.
- Any deposit paid shall not be refunded in any circumstances should the event be cancelled.
Late Payment
- Interest of 10% of the final amount invoiced will be charged and added, every 7 days that the amount does not reach the agency by the due date on invoice.
- The agency has the right to pass outstanding debts to an external organisation to recover the debt on the agencies behalf. An additional 12% fee will be added to the original invoice as well as interest due.
Dissatisfaction of procedure
- In the event that the client is not satisfied with the service provided by the Agency the client must notify the agency within the first 1 hour of the event starting. If the client does not notify the agency, the service will be deemed to have been accepted by the client and the agency will accept no liability and the client shall not be entitled to claim a discount.
- Staff sickness or failure to show for a job is something beyond the control of the agency. The agency will refund the portion quoted for any staff that do not show and will make an effort to replace absent staff with reserves. The client shall not be entitled to claim additional compensation for any loss or damage incurred by the staff “no show”.
Restrictions
- The client is restricted to direct engagement of the agency’s staff. If the client does employ or engage with the agency’s staff, the client will be liable to pay the agency a commission at its then current rates
